These terms and conditions outline the rules and regulations for the use of Daruma Creative Enterprise Ltd's Website, located at https://luckysenpai.co.uk.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Lucky Senpai if you do not agree to take all of the terms and conditions stated on this page.

1. The Promoter

The Promoter is: Daruma Creative Enterprise Ltd, with its registered office at 13 Alexandra Court, Hemel Hempstead, HP2 5XG, UK. Correspondence can be sent to the same address. For any inquiries, please contact us at hello@luckysenpai.co.uk.

2. The Competition

2.1. These terms and conditions apply to all competitions listed on the Promoter’s website at luckysenapi.co.uk (the “Website”).

2.2. By entering the competition, you agree to be bound by these terms and conditions. If you do not agree, you must not enter the competition.

2.3. Competitions may be entered via the Website. Multiple Competitions may be operated at the same time by the Promoter, and each Competition will have a specific Prize or Prizes.

2.4. Availability and pricing of Competitions are at the discretion of the Promoter and will be specified at the point of sale on the Website. There is no requirement to pay to enter any Competition, as each Competition has a free entry route available – see Section 3.3 for details of how to enter for free. The availability of a free entry route means that the Competition does not fall within the definition of gambling under the Gambling Act 2005 and can be operated legally in Great Britain without the need for a licence.

3. How to Enter

3.1. The competition will run from the opening date until the closing date specified on the Website. All times and dates refer to London, England.

3.2. To enter the competition:

  • Go to the Website and view the competition.

  • Select your answer to the competition question (if applicable) and select the number of entries you wish to purchase.

  • Complete the checkout process and submit the online entry form.

  • Complete the payment to receive your order confirmation and ticket number(s).

3.3. Free Entry Route:

  • You may enter the competition for free by sending your entry on an unenclosed postcard by First Class, Second Class, or Signed post to the Promoter at the following address: 13 Alexandra Court, Hemel Hempstead HP2 5XG, UK.

  • Include the following information on the postcard:

    • Your full name as stated in your account.

    • Your address.

    • Your email address.

    • The name of the competition you wish to enter.

  • Incomplete or illegible entries will be disqualified.

  • Entries must be handwritten.

  • You may make multiple free entries for any competition (up to any limit placed on entries by the Promoter), but each free entry must be submitted and posted separately. Bulk entries in one envelope will not be accepted as multiple entries. If a bulk entry is received, it will be counted as one single entry or invalidated if it does not follow these guidelines.

  • By entering the competition, you confirm that you are eligible to enter and accept these terms and conditions.

  • Your entry must be received by the Promoter prior to the Closing Date. Entries received after the Closing Date will not be entered into the random draw.

  • The Promoter will not acknowledge receipt of your entry.

  • If the number of paid entries reaches any cap or limit before your postal entry is received, you will not be entered into the random draw.

  • Entrants must have created an account on the Website for the postal entry to be processed. All details on the postcard must correspond to the details on the account to receive the order confirmation and ticket number. Postal entries received without a registered account cannot be processed.

  • All free entries will be treated in the exact same way as paid entries. Where applicable, these Competition terms and conditions also apply to free entries. All free entries are processed from Monday to Friday of each week.

3.4. The Promoter reserves the right to refuse or disqualify any incomplete Entry if it has reasonable grounds for believing that an Entrant has contravened any of these terms and conditions.

3.5. The Entrant can enter each Competition up to a maximum of 20 times, unless otherwise stated on the specific Competition page.

3.6. All entries must be submitted in English. Entries in other languages will be disqualified, and no refund will be given.

3.7. The Promoter will not accept responsibility for entries that are not successfully completed, lost, or delayed, regardless of cause.

4. Eligibility

4.1. The competition is open to UK residents aged 18 or over, except:

  • Employees of the Promoter.

  • Employees of agents or suppliers of the Promoter who are professionally connected with the competition.

  • Members of the immediate families or households of the above.

4.2. By entering, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require proof of eligibility.

5. Choosing a Winner

5.1. The winner will be chosen by a random live draw conducted on the Promoter’s social media account on the specified draw date. Both online and free postal entries will be included in the draw, and all entries will have an equal chance of being selected, ensuring compliance with the Gambling Act 2005.

5.2. Due to the nature of the selection process, there will only be one Winner per Competition, unless the Promoter explicitly states otherwise.

5.3. The winning ticket number will be announced during the live draw. The winner will be contacted via email and/or telephone within 48 hours of the draw. It is the Entrant’s responsibility to ensure that their contact details are accurate, up to date, and complete. If the details provided are incorrect, incomplete, or recorded inaccurately, the Promoter will not be held responsible for any consequences arising from this, regardless of the nature or cause. Entrants must carefully check that their contact details have been recorded correctly.

5.4. If the Promoter is unable to contact the Winner within 14 days of the draw (or within an extended period at the Promoter’s sole discretion), or if the Winner fails to confirm acceptance of the Prize, or if the Winner is disqualified for contravening these terms and conditions, the Winner will immediately and irrevocably forfeit the Prize. In such cases, the Prize will remain in the possession and ownership of the Promoter.

5.5. In the event that the Promoter closes a Competition early, the Winner will be selected from all valid and eligible Entries received prior to the closure date. However, the Promoter reserves the right, at its sole discretion, to close a Competition early without selecting a Winner. If a Competition is closed without selecting a Winner, the Promoter will refund all paid Entrants for that Competition. Free postal entries will not be returned.

6. Winner’s Details

6.1. The Winner may be required to show proof of identification on delivery of the Prize. Any failure to meet this requirement may result in the Winner being disqualified, and the Promoter retaining the Prize.

6.2. All Winners will be asked for their consent by the Promoter to provide photographs and/or pose for photographs and videos and have their personal details (including details of any Prize won by them) included in marketing material. If a Winner consents to the above, the foregoing photographs, videos, and marketing material may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a Winner of a Competition.

6.3. Following receipt and verification of the details requested above by the Promoter, and provided that the Winner has satisfied these terms and conditions, the Winner will be contacted to make arrangements for the delivery of the Prize.

7. The Prize

7.1. The prize is as described on the competition listing. No cash alternative is available, and the prize is non-transferable.

7.2. The winner can choose to have the prize delivered to an address within the UK or arrange collection at an agreed location. Once the prize has been delivered to the winner, the Promoter is no longer responsible for its condition or any issues arising from its use.

7.3. The Prize will be dispatched within 14 days of the Winner being confirmed, unless stated otherwise. For Prizes that are unreleased at the time of the Winner being drawn, dispatch will be delayed until the Prize is available to the Promoter or the supplier.

7.4. Once the Winner receives the Prize, the Promoter does not insure the Prize. No insurance comes with the Prizes, and the Promoter is not responsible for the Prize once it has been handed over to the Winner.

7.5. Delivery of the Prize to the Winner’s home address in the United Kingdom is free. The Promoter reserves the right to charge the Winner delivery fees if they require the Prize to be delivered to an address outside the United Kingdom.

7.6. All expenses incurred by the Winner to collect the Prize (e.g., travel costs) are the sole responsibility of the Winner.

7.7. The Winner hereby agrees that all Prizes are subject to and conditional on the terms and conditions of the Promoter, Prize provider, manufacturer, supplier, or any other party involved in the provision or delivery of the Prize.

7.8. Each Prize must be accepted as awarded and is non-transferable and non-convertible to other substitutes. The Prize cannot be used in conjunction with any other vouchers, offers, or discounts, including but not limited to vouchers or offers from the Promoter, Prize suppliers, or third parties.

7.9. The Winner is solely responsible for any taxes, duties, or other charges associated with the Prize. The Promoter accepts no liability for any such costs.

8. Payment and Refunds

8.1. Entry fees will be displayed on the competition listing. Payment can be made via credit or debit card.

8.2. Refunds will only be issued if the competition is cancelled. If an entrant is disqualified or withdraws, no refund will be given.

8.3. If a payment is processed but no confirmation or ticket number is generated, a refund will be issued.

9. Data Protection and Privacy

9.1. The Promoter will use entrants’ personal data to administer the competition and verify the winner. Entrants’ details may also be used for marketing purposes, but they can opt out at any time by contacting hello@luckysenpai.co.uk.

9.2. Entrants can request the removal of their details from the database, but this will result in the withdrawal of their entry from any ongoing competitions, with no refund given.

10. Winners’ Personal Data

10.1. Subject to the Winner’s consent, the Winner may be asked to have their photo and video taken by the Promoter for promotional purposes (e.g., Public Relations and Marketing).

10.2. When entering a Competition, the Entrant will be asked to consent to the use of their name, photograph, or other likeness, as well as their appearance at publicity events, without any additional compensation (save for reasonable travel expenses that are approved in writing in advance by the Promoter) and as required by the Promoter.

10.3. By entering the Competition, you agree that the Promoter may use your name, likeness, and Prize details on its social media channels, website, and other promotional materials without additional compensation.

11. Limitation of Liability

11.1. The Promoter makes or gives no representations, warranties, or assurances of any nature (whether in writing or otherwise) as to the quality, suitability, or fitness for any particular purpose of any goods or services advertised, offered, or provided as Prizes.

11.2. Except for liability for death or personal injury caused by the negligence of the Promoter, or for any fraudulent misrepresentation, or for any events or circumstances to the extent that they cannot be excluded or limited by law, the Promoter shall not be liable for any loss suffered or sustained to person or property, including but not limited to consequential (including economic) loss, by reason of any act or omission by the Promoter, its servants, or agents, in connection with:

  • The arrangement for supply, or the supply, of any goods or services to the Prize Winner(s) or any accompanying persons.

  • Any of the Competitions promoted by the Promoter.

11.3. The Promoter is not liable for:

  • Any loss, damage, or disappointment suffered as a result of entering the competition or accepting the prize.

  • Technical issues, including website downtime or lost entries.

  • The condition or delivery of the prize once it has been delivered to the winner. The Promoter will provide a tracking number for shipped prizes, but responsibility for the prize passes to the winner upon delivery.

11.4. The Promoter’s liability is limited to the entry fee paid by the entrant.

12. Electronic Communications

12.1. No responsibility will be accepted by the Promoter for failed, partial, or garbled computer transmissions, or for any computer, telephone, cable, network, electronic, or internet hardware or software malfunctions, failures, connections, availability, or for the acts or omissions of any service provider, internet accessibility or availability, or for traffic congestion or unauthorised human acts, including any errors or mistakes.

12.2. The Promoter shall use its reasonable endeavours to award the Prize for a Competition to the correct Entrant. If, due to reasons of hardware, software, or other computer-related failure, or due to human error, the Prize is awarded incorrectly, the Promoter reserves the right to reclaim the Prize and award it to the correct Entrant, at its sole discretion and without admission of liability. The Entrant who has been incorrectly awarded the Prize will immediately, at their own cost and expense, return it to the Promoter and/or pay the Promoter for that Prize (at the option of the Promoter).

12.3. The Promoter shall not be liable for any economic or other loss, including consequential loss, suffered or sustained by any persons to whom an award has been incorrectly made, and no compensation shall be due to such persons.

12.4. The Promoter shall use its reasonable endeavours to ensure that the software and Website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet, and mobile browsers.

12.5. For the avoidance of doubt, only the Ticket recorded in the Promoter’s systems, howsoever displayed or calculated, shall be entered into the relevant Competition. The Promoter shall not be held liable for any Competition Entries that occur as a result of malfunctioning software or other events.

13. Validation

13.1. The Promoter reserves the right not to award a Prize until it is satisfied that:

  • (a) The Winner has a validly registered Website account and is not in breach of these terms and conditions.

  • (b) Any and all amounts due or owing by the Winner to the Promoter have been paid in full.

  • (c) The identity of the Winner and their entitlement to receive the Prize has been established to the Promoter’s satisfaction. The Promoter reserves the right to request documentary proof of identity and not to award the Prize until such proof has been provided.

  • (d) The Promoter may require proof of age to be produced before awarding the Prize. Prizes will not be awarded to Winners found to be under the age of 18.

13.2. Without prejudice to Section 13.1, the Promoter reserves the right not to award a Prize if it reasonably suspects the occurrence of fraud in relation to a Competition.

13.3. The Promoter may, at its absolute and sole discretion, award a Prize to a person whom it is satisfied is the duly authorised representative of the Winner acting under a lawfully executed power of attorney or other equivalent authorisation.

14. Unauthorised Use of Your Debit/Credit Card

14.1. If you notify your nominated bank (or building society) that your debit/credit card has been used without your permission in relation to a Competition, and your nominated bank (or building society) asks the Promoter to return the relevant amount to your account, the Promoter may ban and suspend your account from future participation.

14.2. The Promoter accepts no responsibility and will have no liability for any chargebacks.

14.3 It is your responsibility to maintain the integrity and protection of your card and personal assets. The promoter removes any and all impact should your child, dog or other individual use your card on our website.

15. General

15.1. The Promoter reserves the right to amend these terms and conditions at any time. The latest version will be available on the Website.

15.2. The competition is governed by English law, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3. The competition is compliant with the Gambling Act 2005 and is structured as a prize competition.

15.4. The exercise by the Promoter of any discretion provided for in these terms and conditions will be final and binding.

15.5. If the Promoter fails or delays to enforce a provision of these terms and conditions, this failure or delay is not a waiver of the Promoter’s right to do so later.

15.6. If any provision (or part of a provision) of these terms and conditions is found by a court of competent jurisdiction to be void or unenforceable, that decision will only affect the particular provision (or part of the provision) and will not, in itself, render the other provisions void or unenforceable.

15.7. You may not assign or otherwise transfer (in whole or in part) your rights or obligations under these terms and conditions. Any breach of this rule may result in the suspension or termination of your account, access to the Website, or participation in the Competition. The Promoter may assign or transfer its rights and obligations under these terms and conditions, in whole or in part, to any third party at its sole discretion and without your consent. This includes assignments in connection with a merger, reorganisation, or sale of all or substantially all assets or equity. These terms and conditions shall bind and benefit the Promoter, its successors, and permitted assigns.

15.8. These terms and conditions constitute the entire agreement between you and the Promoter regarding the subject matter and supersede and replace any prior or contemporaneous agreements, terms, or conditions applicable to the subject matter.

15.9. A person who is not a party to these terms and conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 (as amended or re-enacted) or otherwise to enforce any provision of these terms and conditions.

15.10. The Promoter shall not be liable for any failure or delay in performing its obligations under these terms and conditions due to events beyond its reasonable control, including but not limited to pandemics, natural disasters, acts of terrorism, or government restrictions.

15.11. The Promoter reserves the right to cancel, suspend, or amend the Competition at any time, including after the Competition has started, if circumstances arise that make it necessary to do so.

15.12. The Website may contain hyperlinks to websites operated by third parties. These links are provided for your reference and convenience only. The Promoter does not control such websites and is not responsible for their content, privacy practices, or other policies. It is your responsibility to ensure that any links you select or software you download from such websites are free of viruses. The inclusion of hyperlinks does not imply endorsement, association, sponsorship, or partnership with the operators of such websites. You must not create a text hyperlink to the Website without the Promoter’s prior written consent.

15.13. All Ticket Purchases are final unless there is just cause for a refund, which will be determined at the Promoter’s sole discretion. Instant win tickets are entries that are instantly drawn, and no refunds will be issued for these tickets under any circumstances.

15.14. Instant wins are automatically updated in the Promoter’s system. However, due to system queues or high traffic, there may be delays in updating instant win availability. The Promoter recommends checking with customer support if you are unsure about instant win availability. In the event of system issues beyond the Promoter’s control, the Promoter absolves itself of any liability and will not issue refunds, as outlined in these terms and conditions.

15.15. Any disputes arising out of or in connection with these terms and conditions shall be resolved through good-faith negotiations. If the dispute cannot be resolved, the Promoter will hold the right to make the final decision.

15.16. If you have a complaint about the Competition, please contact the Promoter at hello@luckysenpai.co.uk. The Promoter will acknowledge your complaint within 7 working days.

15.17. Any attempt to manipulate the Competition, including the use of bots, multiple accounts, or fraudulent entries, will result in immediate disqualification and suspension of account(s), and may lead to legal action.
